Terms and Conditions
By creating an account or using Lookie, you agree to these Terms. If you don't agree, please don't use the service.
1. The Service
Lookie is a screen recording and video messaging platform operated by Pixelspace, LLC. The service allows you to record your screen, upload videos, and share them via link. Your use of the service is subject to these Terms.
2. Your Account & Eligibility
You must be at least 16 years old to use Lookie. By creating an account, you confirm that you meet this requirement. You are responsible for:
- Keeping your login credentials secure.
- All activity that occurs under your account.
- Ensuring the information you provide is accurate.
3. Prohibited Content (HIPAA & Sensitive Data)
Lookie is a general-purpose communication tool and is NOT intended for the storage or transmission of highly sensitive data. You agree NOT to use Lookie to record or store:
- Protected Health Information (PHI) subject to HIPAA regulations.
- Unencrypted financial records or credit card data (PCI-DSS).
- Highly classified government or corporate secrets.
Pixelspace, LLC disclaims all liability for any damages resulting from your decision to record or store sensitive information.
4. Your Content & Participant Consent
When you upload recordings to Lookie, you retain ownership of your content. However, you are solely responsible for:
- Consents: You represent and warrant that you have obtained all necessary consents from third parties (including audio, visual, and biometric/voice consent) before starting any recording.
- Legal Rights: Ensuring you have the right to record and share the content without violating the privacy or intellectual property rights of others.
- Ownership & Licensing: By uploading content to Lookie, you represent and warrant that you own all rights to the uploaded material or have obtained all necessary licenses, permissions, and authorizations from the rights holders to upload, store, and share it through the service. You agree not to upload content that infringes the copyright, trademark, or any other intellectual property rights of any third party. Pixelspace, LLC disclaims all liability arising from your failure to hold the appropriate rights or licenses to any content you upload.
5. Video Expiration & Deletion
- Videos expire automatically based on the period you set (24 hours, 7 days, or 30 days).
- Public Inactivity: Once a video expires, the public link becomes inactive immediately.
- Grace Period: We retain the video file for seven (7) additional days in an "Expired" state for internal recovery purposes only. After this period, it is permanently deleted and cannot be recovered.
- No Bulk Export: Lookie does not currently support bulk exports. It is your responsibility to manually download local copies of any recordings you wish to keep.
6. Plans, Billing & Refunds
Lookie offers Free and Pro plans.
- Subscriptions: Pro plans are billed as a recurring subscription via Stripe.
- Refund Policy: Except as required by law or as expressly stated in our Refund Policy, all payments are non-refundable. You may cancel your subscription at any time through the billing portal in Settings to avoid future charges.
- Price Changes: We reserve the right to change pricing with reasonable notice via email.
7. AI Transcription (OpenAI Whisper)
Lookie offers transcriptions using OpenAI's Whisper API.
- Privacy: We use the API version of Whisper; your audio data is processed to generate text and, per our agreement with the provider, is NOT used to train machine learning models.
- Accuracy: Transcription accuracy is not guaranteed. Do not rely on transcriptions for legal, medical, or critical purposes.
8. Service Availability & Maintenance
Lookie is provided "AS IS". While we strive for high availability, we do not guarantee uninterrupted service. Scheduled maintenance or brief technical updates do not constitute service outages or breaches of these Terms.
Pixelspace, LLC shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, or third-party infrastructure and service outages (e.g., Render, Mux, or Stripe failures).
9. Limitation of Liability
To the maximum extent permitted by law, Pixelspace, LLC shall not be liable for any indirect, incidental, or consequential damages (including loss of data, profits, or unauthorized account access) arising from your use of Lookie.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pixelspace, LLC and its officers from and against any and all claims, damages, liabilities, and legal fees arising from (i) your use of the Service, (ii) your violation of these Terms, or (iii) your recording or sharing of content that infringes the privacy or intellectual property rights of any third party.
11. Third-Party Services
Lookie relies on third-party providers: Mux (Video), Stripe (Payments), OpenAI (Transcription), and Resend (Email). We are not responsible for the independent availability or conduct of these services. A list of current sub-processors is available upon request.
12. Intellectual Property
The Lookie application, website, code, logos, and branding are the property of Pixelspace, LLC. These assets are protected by copyright and trademark laws. You may not reproduce or use them without our written permission.
13. Termination
You may delete your account at any time through the Settings menu. We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms, non-payment, or conduct that we believe is harmful to other users, our business interests, or the public. Upon termination, your right to use Lookie will cease immediately, and your data will be handled according to our Privacy Policy.
14. Business Transfer
In the event that Pixelspace, LLC is involved in a merger, acquisition, or sale of assets, your personal information and content may be transferred as part of that business transaction.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Washington, USA.
- Binding Arbitration: Any dispute arising from these Terms shall be resolved through binding individual arbitration in Washington.
- Class Action Waiver: You agree to resolve disputes with Pixelspace, LLC on an individual basis and waive any right to pursue a class action or collective proceeding.
16. DMCA / Copyright Policy
If you believe content on Lookie infringes your copyright, please notify us at lookie@pixelspace.com with the specific URL and evidence of ownership.
17. Changes & Contact
We may update these Terms at any time. Continued use of Lookie after changes constitutes acceptance.
